The ACLU of Delaware is suing the Delaware Department of Corrections for prison abuse
SMYRNA Del. – The American Civil Liberties Union of Delaware is suing the Delaware Department of Corrections after allegations of prison abuse. The incidents took place inside the James T Vaughn Correctional Center.
Dwayne Bensing works as the Legal Director for the ACLU and told WMDT of the alleged violence filed against the state.
“We have allegations of close-range pepper spray, sexual assaults, and physical violence, including punching and kicking, so forcefully that one of our clients’ teeth pierced through his lips.”
Six prisoners claim prison staff committed these crimes during an unprovoked September 2024 raid. Bensing is hoping for justice from these incidents.
“That’s why we are seeking injunctive relief. What we want is a court order telling the warden and the CERT team to knock this off immediately.”
The ACLU of Delaware represents the people from across the First State. Bensing said they will continue to serve as a voice for those who need it.
“Even if you think people who are convicted of crimes should be in prison, we also as Americans think people are innocent until proven guilty, and surely innocent people should not be subject to such acts of cruelty.”
WMDT reached out to the Delaware Department of Corrections. Officials said they could not comment on pending litigation.
