Motion filed to dismiss JTVCC inmates’ lawsuit

An attorney for the acting warden of the James T. Vaughn Correctional Center has filed a motion to dismiss a class action lawsuit by plaintiffs who are inmates at the prison.

Online court records show that Deputy Attorney General Joseph Handlon filed a motion on behalf of Acting Warden David Pierce.

The lawsuit alleges that since the February 1st hostage situation, inmate property has been destroyed, inmates have been isolated, health treatment has been denied and some inmates have suffered traumatic stress.

Handlon says that the class action does not show that the practices are unconstitutional or how the injunction would not cause greater harm to the acting warden or the state.
