Accused murderer fighting extradition in Delaware

New developments on James Clay as he fights his extradition back to Arkansas. You’ll recall, Clay is accused of murdering a man back in 1967.
Clay’s attorney tells 47 ABC, Clay is being held illegally as he fights extradition. He argues an Arkansas sheriff’s affidavit seeking an arrest warrant is not valid because there is no verification on it saying it’s notarized. Clay’s attorney says he recently filed for habeas corpus, arguing that Clay should be released on the grounds that the warrant is invalid.
That will be heard in Superior court, where officials tell 47 ABC, expect a decision within 72 hours.
According his attorney, even if Clay is released, he still faces an extradition hearing. Officials with the Department Of Justice say there is no date set for that just yet.
