Marijuana to become decriminalized in DE Friday

On Friday, House Bill 39 will go into effect, officially decriminalizing marijuana.

Delaware will be the 19th state to eliminate the jail threat associated with simple marijuana possession.

Adults will now face a $100 fine.

Those from ages 18-20 will face a $100 civil fine for their first offense.

Thereafter, they would face a misdemeanor which could be expunged from their records once they turn 21.

Possession by minors and the public consumption of people of any age will remain a misdemeanor.

47 ABC spoke with one state lawmaker who isn’t completely against the idea, but thinks a test needs to be developed.

“I would be for it if there was some way to test for being under the influence, there is no test,” Senator David Lawson, (R) District 15, tells 47 ABC.

Governor Markell signed the bill into affect six months ago on June 18th.
