Constitutional Law Prof. weighs on in Trump SCOTUS Decision

WASHINGTON – In a unanimous decision the Supreme Court ruled that Colorado did not have the right to remove the former president from the ballot.

Now following that decision new scrutiny is being directed at the Supreme Court decision, with Constitutional Law Professor Dr. Samuel Hoff calling the decision far from unanimous on the principles argued, regardless of the vote.

“The court found narrowly that yes colorado did not have this ability but there was serious dissent from the liberal justices on the idea that this was a question, of rights that could only be settled by Congress, not the courts or the rights of the states,” Dr. Hoff said.

He says the decision also signals a reversal on issues of federal supremacy, and state’s rights.

“I think that’s a little inconsistent from a conservative standpoint, looking at that ruling, and, you know, we see the court supporting the states on so many other things, most vividly on the abortion, on the Dobbs decision, on abortion a couple of years back, but certainly on other cases,” Dr. Hoff said.

Hoff adds it also directly contradicts the ruling of Conservative justice Clarence Thomas in a 1995 ruling against presidential term limits, where he argued for federal oversight on any attempts to change term limits by state legislatures.

Dr. Hoff says this could also be a preview of how the court could rule on Trump’s claim of immunity from prosecution regarding the January 6th insurrection.
