Assault conviction overturned for Pocomoke City man

POCOMOKE, Md. – A Pocomoke man serving time for second degree assault recently had his conviction overturned.

James “Troy” Durham was convicted on second degree assault charges in January of 2020 and was sentenced to 7 years behind bars in June of 2020. However, Durham’s conviction was overturned by the Court of Special Appeals on the basis that the presiding judge erred by excluding testimony that should have been admitted at trial.

Durham became eligible for parole after serving 25% of the 7-year sentence, which equates to 639 days, and was actually incarcerated for a total of 745 days as a result of the now-overturned conviction.

The Worcester County State’s Attorney’s Office released a statement on the overturn, saying “After thoughtful consideration and consultation with the victim and family, the Office of the State’s Attorney for Worcester County will not prosecute Mr. Durham for what would be the 4th time on this charge.”
