UPDATE: OC Boardwalk performers seek jury trial

A new chapter in the battle between the town of Ocean City, and its boardwalk performers.

A federal complaint filed last month, is now seeking a jury trial regarding an ordinance enacted earlier this year. According to court documents obtained by 47 ABC, the complaint is asking for the ordinance to be dismissed, one million dollars from the town along with one million dollars from shop owners.

The suit claims that shop owners “have acted illegally to deprive the boardwalk performers of their constitutional rights.”

This all comes after a July ordinance that required performers to sign up a week prior to performing and regulated where they could stand. 47 ABC reached out to Ocean City Solicitor Guy Ayres, who tells us the town has no official comment, but will file the necessary response when the time comes.
