AG Jennings Responds to DUI Arrest of Former Sussex Co. Prosecutor

GEORGETOWN, Del. – Delaware Attorney General (AG) Kathy Jennings responded to the recent DUI arrest of former Sussex County Prosecutor Martin Cosgrove on Wednesday morning. 

“I was extremely disappointed to learn that one of our senior prosecutors in Sussex County, Martin Cosgrove, drove under the influence and damaged property in a hit-and-run,” AG Jennings said in the statement. “He has been charged and will be prosecuted.”

AG Jennings was sure to quell any concerns about personal or professional conflict in the handling of these charges, stating that the case has been assigned to the Director of the Family Division. The assigned prosecutor works in a different county, Division, and Court than Cosgrove. 

I have stated before that the point of the law is to guarantee that, regardless of the individuals, we all play by the same rules. Prosecutors are agents of the law, but we are not and must not be above it,” she continued. 

Yet, AG Jennings spoke fondly of Cosgrove despite the pending charges.

“This is a very sad moment for everyone who knows Marty well at the Department of Justice.  He has been a decades long friend and colleague whom I have always admired. And he has been a deservedly well-respected prosecutor and member of the Sussex County Bar who recently served as Chief Sussex County Prosecutor,” she said. “I am grateful that nobody, including Marty, was hurt.”

She ended her statement by condemning drunk driving, calling the act a public safety threat that we cannot tolerate.
