Local realtor files complaint vs City of Salisbury and local developer
SALISBURY, Md. – A local realtor filing a lawsuit against the city of Salisbury and a local developer. Holly Worthington of Worthington Realty is providing WMDT with an update on the current lawsuit.
She claims the conveyance of the parking lot to ‘Gillis Gilkerson’ was invalid.
Gillis is the group that would be behind the potential Salisbury Town Center complex. The proposed apartment structure would be a boost for the downtown, with many proponents saying it would revitalize the plaza.
Worthington’s attorney, Anthony Gorski, explains how things stand currently.
“It’s not about not wanting development for residences or new developments downtown. She is very much in favor of that, but the problem is the way it was gone about by removing all of the parking lots, without providing adequate parking, especially for people on the lower end of the plaza, creating a very different problem.”
The lawsuit is a declaratory judgment complaint, which would seek to undo the sale of the parking lots – and undo the contract for development.
It would ultimately require the city of Salisbury to go back through the procedural process.
Worthington and her attorney have been working with the circuit court on scheduling discussions. “We are in the discovery phase now, when the parties are serving each other with requests to documents and answering those requests. We will also be subpoenaing a number of documents from different people who we think will show the problems we are pointing to and how this came about in a way that doesn’t satisfy the law.
Gorski tells WMDT that he expects the trial to begin sometime in August.
