Del. State Representative pleads guilty to DUI
DELAWARE – A Delaware State Representative entered a plea agreement in a 2024 drunk driving crash.
On November 9, 2024, 59-year-old Kevin Hensley, a state representative from the Townsend area, pulled out in front of a gray Ford Fusion while leaving the parking lot of a Valero gas station on Route 1 in Milford. The Ford reportedly rolled over before coming to rest. The victim sustained lacerations and complained of chest pain where the airbag hit him.
The victim passed away several weeks later from a separate medical issue, attributed by the Medical Examiner to a stroke and brain tumor.
Hensley failed field sobriety tests and registered a 0.142 blood alcohol concentration on a breathalyzer and a 0.16 BAC on a blood draw.
Hensley pleaded guilty to third degree vehicular assault and driving under the influence and will have his drivers license revoked for one year, serve probation while undergoing required DUI instruction, and pay a $500 fine. His sentence includes a suspended 18 month prison sentence.
Officials say Hensley has a prior conviction for alcohol related reckless driving from 2009, however, under state law, the prior DUI must have occurred within ten years to be considered a second offense.
