DSP arrest Lewes man after he was seen inside of his car with a syringe in his arm at Walmart
REHOBOTH, Del.- Delaware State Police arrested a Lewes man after they responded to an overdose complaint Saturday night at a Walmart.
Police said around 10:30 p.m. troopers were dispatched to the Walmart, located at 18922 Rehoboth Mall Blvd, for 35-year-old Benjamin Buckley, who was seen passed out inside of his car with a syringe in his arm.
We are told before troopers arrived, Buckley drove away.
Officers then went to the registered owner’s house and found Buckley still in the driver seat of the car with the ignition on.
Police say they observed signs of impairment and the smell of marijuana coming from inside the car.
A DUI investigation ensued and a computer inquiry revealed Buckley had four previous DUI convictions.
Officers say inside the car they found approximately 3.42 grams of marijuana, approximately .33 grams of crack cocaine, approximately .56 grams of heroin, 4 Buprenorphine Hydrochloride pills, and 1 Gabapentin pill.
Buckley is now facing charges that include:
- 5th Offense DUI-alcohol (felony)
- Possession of a Controlled Substance – 3 counts
- Possession of a Prescription Drug without a Prescription
- Possession of Marijuana
- Possession of Drug Paraphernalia
- Failure to Have Insurance Identification in Possession
Buckley was arraigned in Justice of the Peace Court #7 and committed to Sussex Correctional Institution in lieu of $5,401.00 secured bail.
