JTVCC Trial Group 2: Closing arguments wrap up

WILMINGTON, Del. – 47 ABC has a crew in New Castle County Tuesday, as closing arguments continue for group two of James T. Vaughn riot trials.

The second group includes Abednego Baynes, Kevin Berry, John Bramble, and Obadiah Miller.

Tuesday morning, John Bramble’s lawyer, Tom Pedersen echoed the other three defense lawyers, that there’s a dizzying array of contradictions and inconsistencies. He even said, “Who of the 13 state witnesses do you trust?” Pedersen also said the state had no real evidence to rely on.

But the state had their chance to make their final remark.

According to the State, they believe that if each and every story was the exact same, it wouldn’t be credible so it makes to have different testimonies.

Prosecutors claim that three things equate to the different testimonies: movement, time and vantage. The State says the attacks happened in a span of 7 minutes and witnesses are seeing different movements, at different times and at a different vantage point and no two stories can be the same.

All four defense attorneys asked the jury for a not guilty verdict for their clients. And for the prosecutors, they ask that each and every one should be found guilty under the accomplice liability theory.

But now it all relies on the jury, as they determine four different outcomes.

For the first group of men, it took 21 hours to reach a conclusion with Dwayne Staats getting a murder charge and Deric Forney getting acquitted.
