State Prosecutor hopes to retry former Pocomoke City police chief case
POCOMOKE CITY, Md. – Former Pocomoke Police Chief Kelvin Sewell may be re-tried after the court of special appeals overturned his guilty verdict Thursday.
Sewell was found guilty of misconduct in office in 2016, but the high court decided to overturn the decision because he wasn’t allowed to present all of his witnesses.
In that case the state claimed that Sewell had improperly handled a traffic incident involving one of his fellow brothers from the Masonic Temple.
47 ABC reached out to the Office of the State Prosecutor Friday who says they most likely will re-try this case.
“Although we are disappointed that the case was remanded, but we’re gratified that the court held that there was no verifiable evidence whatsoever that our office had engaged in prosecution misconduct in bringing the charges, which is what Mr. Sewell had alleged throughout the trial and before,” explains State Prosecutor Emmet Davitt.
Davitt believes they have a strong case, but adds they will have to reach out to their witnesses before fully deciding to move forward.
