Man charged with weapons offenses after DUI

SELBYVILLE, Del. – State police charge Michael R. Smith, a 41 year-old Seaford man, with several criminal offenses after a DUI investigation.
Police say Smith had a loaded .38 caliber handgun in his possession after they conducted a vehicle search during the investigation.
Authorities report at approximately 1:39 am Sunday, the Selbyville Fire Company found Smith unconscious while his vehicle was parked in the roadway in the area of West McCabe Street west of Rodgers Avenue.
Officials made contact with Smith after he regained consciousness and had a strong odor of alcohol in his breath.
His vehicle had a flat front driver side tire and a damaged left front headlight with grass through-out the damage. Police say Smith could not advise on how the damaged occurred.
After running a computer check, police found Smith previously convicted of a felony in Sussex County Superior Court.
As a result of their investigation, police transported and charged Smith with the following offenses:
- Two Counts of Possession, Purchase, Own or Control of a Firearm or Ammunition by a Person Prohibited Prior Violation
- Carrying a Concealed Deadly Weapon A Firearm
- Possession of a Firearm while under the influence
- Driving a Vehicle Under the Influence of Alcohol
Smith was arraigned before the Justice of the Peace Court #3 and taken to the Sussex Correctional Institution in default of $33,500.00 cash bond.
