Salisbury Station 13 files lawsuit against Community Foundation of the Eastern Shore

Salisbury Independent Volunteer Fire Company Number One Station 13 filed a lawsuit against the Community Foundation of the Eastern Shore, on November 21, in Wicomico County.

Court documents allege that the Community Foundation is withholding money from its Lacy Fund. Salisbury Independent Volunteer Fire Company number one station 13, who separated from the City's Fire Department, believe that they have a right to the Fund, that is supposed to give money to Salisbury volunteer firefighters.

The fund was originally set up as a part of the will of Katharine Lacy who asked that the money be used to fund the Salisbury Fire Department for its general corporate uses and purposes. The company, who says that they have apparatus and equipment, is asking for its costs and expenses including reasonable attorney's fees.

47 ABC reached out to Erica Joseph, president of the Community Foundation of the Eastern Shore, who says,

"In July 2017 we requested documentation from Station 13 in regards to this matter. We had not received any written response to that request prior to the filing of this lawsuit. Without the requested information, we have very little to base grant eligibility on.

C.F.E.S. continues to be devoted to our regional community by assisting local nonprofit organizations and fostering the charitable endeavors of our donors."

47 ABC reached out to volunteer firefighters who say the lawsuit was filed to re-establish the flow of funds from the Lacy Fund, and that they are hoping to settle the matter outside of court, but will go to court if needed.
