Wilmington man facing third DUI charge in Rehoboth Beach

A man is facing his third DUI offense, after police say he illegally passed an officer and drove on the sidewalk, in Rehoboth Beach.

The Rehoboth Beach Police Department says on Saturday, around 11:00 PM, an officer was sitting at a stop sign along Wilmington Avenue, where he saw 51-year-old James Leone, of Wilmington, driving a silver Jeep Wrangler illegally pass him on the right.

Police report that the officer began to follow Leone when he reportedly drove over a curb and sidewalk at the intersection of Rehoboth Avenue and First Street. According to the report, the officer then pulled over Leone along Rehoboth Avenue, and noticed that Leone was showing signs of intoxication. Authorities say that standardized roadside field sobriety tests were issued, and Leone was taken into custody and transported to Beebe Healthcare for further analysis.

Leone was arrested and charged with one count of felony third offense driving a vehicle under the influence of alcohol, one count of passing on the right, and one count of driving a motor vehicle on the sidewalk.

He was released on $5, 250 unsecured bail to a sober co-signer.
