Judge rules mistrial in Carlini case

A Worcester County Circuit Court judge has ruled a mistrial in the felony theft case for Joseph Carlini.
The case was heard Thursday, but the judge declared a mistrial after he determined the jury could no longer be impartial. According to the state's attorney's office during deliberations a juror passed a note to the judge saying some of the jury realized they knew Carlini and were familiar with other allegations against him.
Carlini stands accused of stealing a $5,000 deposit check that was going to be used to purchase a car.
The state plans to re-try the matter.
Meanwhile Carlini's attorneys tell 47 ABC they may file to have the case tried somewhere else claiming the suspect may not get a fair trial in Worcester County.
"I think that's one of the concerns is that a lot of people have watched this reported as news now that will ultimately be up to the court. Most of the times if you have a case on one side of the state it's going to be moved to the other but that doesn't necessarily have to be the case it's up to the judge," said attorney Luke Rommel.
Carlini is looking at two other felony theft charges aside from the one in question.
