Salisbury gas station fight resolved in court

Earlier this year a cell phone video surfaced showing a man beating up a teenager at a Salisbury Shell gas station. Both were charged with second degree assault and Thursday they had their day in Wicomico County District court. 

Wicomico County State’s Attorney’s Office officials say 31-year-old Marcus Lee Smiley pleaded guilty to an affray charge, which by definition is common law assault and battery.

Meanwhile 18-year-old Elijah Dutton Fooks had his charges dropped because the state concluded the cell phone video backed up Fooks’s allegation that he mistakenly approached the car Smiley was in and that Smiley initiated the fight.
