Six accused of stealing $640k+ from Millsboro American Legion post

Six former officers at a local American Legion Post are facing charges, after they apparently stole more than $640,000 in funds from the organization.

The Department of Safety & Homeland Security, Delaware Division of Gaming Enforcement says back in January, the American Legion Post #28, Millsboro contacted them, stating that six post officers, either past or present, had stolen funds from the organization between July 2012 – January 2015.

That investigation reportedly revealed that the suspects, who were Post #28 officers at the time, wrote and signed numerous checks out to cash, before cashing the checks at local banks. Those funds were apparently never returned to or used for American Legion Post #28 business.

On Thursday, Investigators say they wrapped up their three month long felony theft investigation, which totaled a loss of $641,100 for the American Legion. Arrest warrants were obtained for the suspects for charges related to embezzlement. Officials say they also searched the home of Samuel Mauger, 65, on Pear Street in Millsboro.

The five suspects, identified as Mauger; James Gallagher, 65, of Millsboro; Edward Mazewski, 69, of Millsboro; Michael Rooney, 66, of Georgetown, and Charles Nimmericher 53, of Millsboro were all arraigned, and released pending later court dates. Mauger was charged with two counts of felony theft over $100,000 for the $376,660 total he is accused of stealing. Gallagher, Mazewski, and Rooney were each charged with two counts of felony theft over $1,500. Gallagher for $13,000 total, Mazewski for $20,000 total, and Rooney for $13,000 total. Nimmericher had a misdemeanor theft under 1,500 charge, for the $400 total he is accused of taking.

Officials say a sixth suspect was identified for stealing $218,040 in funds; but that person has apparently died.
