Millsboro man charged with heroin possession and 4th DUI

Delaware State Police say around 1:30 PM Saturday the Sussex County Emergency Operations Center began receiving calls of an erratic driver, heading south on US13.

We’re told 29-year-old Phillip B. Spear of Millsboro eventually stopped the car in the right turn lane at the intersection of US13 and Ockels Drive. Troopers say they received reports that Spear was slumped over the wheel while stopped.

According to DSP, after troopers made contact with Spear, they smelled alcohol and found an empty heroin bag on his shirt. Following a K-9 search, troopers then apparently found three more bags of heroin and drug paraphernalia in the passenger’s seat.

Police say Spear was driving under the influence and had three prior DUI convictions, dating back to 2006.

We’re told Spear is facing 4th offense DUI of a combination of alcohol and any drug, possession of heroin and possession of drug paraphernalia.

Spear is reportedly being held at Sussex Correctional Institution on $5,000 cash bond.
