UPDATE: Charges for carjacking case against Harper dismissed

A superior court judge has dismissed all charges against Rondaiges Harper, due to double jeopardy.

Harper was one of three teens arrested in 2013, for holding 89-year-old Margaret Smith in the trunk of her own car for three days before dumping her in a cemetery alive. Harper was indicted by a grand jury in August on two charges first degree false imprisonment and second degree conspiracy.

This, after the Delaware Supreme court reversed a previous conviction in this case earlier this year. According to the decision handed down on Thursday, the judge says because the conviction was overturned by the supreme court due to a lack of evidence, Harper cannot be tried on the same charges, or lesser charges relating to the case.

The judge also cited the fact that no new evidence was brought forward.
