Extradition hearing for James Clay voided

68-year-old James Leon Clay of Georgetown

The Georgetown man, arrested last month in connection to a 1967 Arkansas murder was in court Thursday morning.

But officials say, it was all for nothing. James Clay’s extradition hearing was supposed to be on Friday, but when it got moved to Thursday, apparently no one told the Delaware Public Defender’s Office, so Clay appeared without any representation.

The judge ordered him to be extradited back to Arkansas but, because the Public Defender was not present, it’s all null and void.

Officials with the Department of Justice say Clay will remain in Delaware while awaiting a new hearing date. When he was arrested last month, Clay was charged with being a fugitive from another state and was held without bail.
