Milton Man Charged With Assaulting Police Officer

MILTON, Del. - A Milton man has been charged, after he apparently assaulted a Police Officer during his arrest.

Milton Police say on Friday just before 8:25 PM, Officers responded to a physical domestic in progress at a home on Nellie Drive. Once on scene, Officers say they found 32-year-old Brian Kaczala fighting with a 63-year-old man, causing non-incapacitating injuries. An investigation reportedly showed that while the victim was calling 911, Kaczala took the phone from him, and threw it onto the floor, where it broke.

According to the report, as the Officer attempted to arrest Kaczala, he started to resist arrest, so the Officer requested backup. A Delaware State Police Trooper was able to help, and while Kaczala was being secured, he apparently kicked the Milton Officer in the knee.

Kaczala, who refused to be processed, was charged with three felonies, including assault 2nd degree victim over 62 years of age, assault 2nd degree victim Police Officer, and resisting arrest with force, along with three misdemeanors including, failure to comply with taking photo/fingerprints, malicious interference emergency communications, and criminal mischief. He is reportedly being held at the Sussex Correctional Institution on $13,500 bond.

The 22-year-old Milton Police Officer was treated at Beebe Healthcare for a sprained knee, and released.
