UPDATE: Smith Takes Stand In Accomack Co. Arsonist Trial

VIRGINIA BEACH, Va. - Day one of the trial against a convicted Accomack County arsonist started Monday morning across the Chesapeake Bay.

Tonya Bundick entered the Virginia Beach courtroom around 9:00 AM for jury selection and then the start of her next trial. The Parksley woman made an Alford plea in her first trial involving the arson cases back in January, essentially accepting there was enough evidence to convict her but maintaining she's not guilty.

This trial sets up the first in her next indictment, 62 total charges and possibly 62 trials, after a judge granted a separate trial request back in April.

As of 11:30 PM, no jury selections had been made. Six of the potential 28 people in the pool had knowledge of the case, and two more were dismissed due to biases. Jury selection wrapped up around just after 12:00 PM with a total of 14 jurors selected, including two alternates.

The fire that Bundick is facing one felony charge of maliciously destroying a building, happened on March 3rd, 2013. Charles Smith reportedly told Police after his arrest, that Bundick dropped him off on the farmland in Keller, and he set the fire in the attic of the building using boxes and soccer balls.

On the stand before the trial broke for lunch were a Melfa firefighter, who was the first on the scene, and says when he arrived, there was "nothing but fire." Also on the stand were the owner of the property, and the lead investigator for the Virginia State Police, who said there were two footprints found at the scene, that did not match each other.

After lunch Smith, Bundick's alleged co-defendant and former fiance, testified against her. He explained the events of that evening, and said that he still loved Bundick. Smith was cross examined. In October of 2103, Smith pleaded guilty to 68 counts related to the burning buildings throughout the Eastern Shore county.

More than 70 fires were lit in Accomack County beginning in November 2012, a majority blamed on Bundick and Smith with several copy-cat arsons.

The Common Wealth of Virginia was not allowed to mention any other fires in opening statements.
