UPDATE: Gunman Dead After Shootout With Trooper

MAGNOLIA, Del. - A gun battle breaks out in the quiet neighborhood of Linkside in Magnolia, Delaware, ending with the suspect dead and a state trooper in the hospital.

"I heard the boom, boom, boom, boom, boom," neighbor Kimberly Jara said.

Twenty-nine-year-old Dennis Hicks of Milford was wanted on strangulation charges after a reported domestic dispute with his girlfriend Tuesday night. It happened around 12:30 a.m. at a home on Bayhill Road, in the Linkside development.

"The girlfriend was actually at our house hiding when they called the cops. She said that last night he had pulled a knife on her and threatened to kill her last night," neighbor Patrick Scannelli said.

Several hours later, 26-year-old Lloyd McCann, a four-year veteran on the force, spotted Hicks driving a Honda Accord on Route 1, north of Milford, just before 7 a.m.

"As the trooper caught up with the vehicle, the vehicle attempted to flee from the trooper who activated his emergency equipment," Corporal Gary Fournier of the Delaware State Police said.

Hicks fled northbound on Route 1, to Mulberrie Point Road and then onto Clapham Road, towards Magnolia, then stopped on Bayhill Road at West Birdie Lane at Linkside. Police say he then got out of his car and began shooting at Trooper McCann, hitting him in the cheek and hand. Trooper McCann fired back, hitting Hicks in the upper body.

"I saw him in the middle of the road and there was a lot of blood," Jara said.

Both were taken to Kent General hospital where Hicks was pronounced dead at 8:47 a.m.

Trooper McCann was then flown to Christiana Hospital in serious but stable condition.

Police say the semi-automatic handgun that was recovered from the scene, was reported stolen during a residential burglary in Smyrna, in June 2013.    

Trooper McCann has been placed on administrative leave, which is division policy, but the preliminary investigation indicates that Hicks fired first.
