DE Public Safety Bill Passes Senate

DOVER, Del. - A bill aimed at closing a loophole which allowed people diagnosed with a mental health disorder to own a deadly weapon unanimously passed in the state Senate.

The bill expands the crime of possession and purchase of deadly weapons, adding juveniles and adults who have been found "Not Guilty By Reason of Insanity", "Guilty But Mentally Ill" or "Mentally Incompetent to Stand Trial" to the list of prohibited persons.

"Those classes of people already are prohibited from purchasing a firearm but through a loophole they can legally possess a firearm," said Sen. Brian Pettyjohn (R). "This closes that loophole and make sure that people that are mental unstable don't have access to firearms."

The bill now heads to a House committee.
