UPDATE: Former Daycare Worker Takes Plea Deal, Guilty Of Abusing Toddler

WICOMICO Co., Md. - A former daycare worker who abused a three-year-old boy in April, was sentenced Monday morning.

Forty-seven-year-old Fay Bartley of Fruitland, Md. pleaded guilty to second degree assault. As part of the plea agreement, the reckless endangerment and the contributing to the condition of a child charges were dropped. She will be on supervised probation for the next two years, and the judge prohibited her from ever working in another daycare facility or having a minor under her care.  

This after she abused a three-year-old toddler at the Child Development Center located inside Emmanuel Wesleyan Church in Salisbury, back on April 3rd. Surveillance video captured Bartley yanking the boy by the arm and dropping him on the floor -- leaving fingernail scratches and bruises. He was later diagnosed with a wrist sprain.

"I feel sad that this situation occurred. And we just wanted to bring awareness to the community that this kind of stuff does happen," the father of the child Neil Hallowell told 47 ABC.   

The judge stated "the only reason you're not going to jail is you have no record."

"She had no prior record. Never been in trouble before this, and that's what the court needed to know," defense attorney Robert Fine said.

The mother of the boy gave emotional testimony in court, stating that his physical wounds have healed, but the emotional damage is beyond repair. The boy was diagnosed with epilepsy this past January, and since the abuse in April, the family says the boy has become withdrawn, has frequent nightmares and bites his nails.

"It's been a rough and bumpy road, but hopefully therapy will help him get through whatever emotional problems he needs to get through, Hallowell said.

If Bartley violates her probation, she'll serve 12 months behind bars. The pastor of Emmanuel Wesleyan Church declined to comment on the matter. At this point, it's unclear if there were any other incidents of abuse or other children involved.
