Delaware Pot Decriminalization Set For House Vote

Posted: Updated:

DOVER, Del. (AP) - A bill decriminalizing possession of small amounts of marijuana by adults in Delaware has been released by a legislative committee for a vote in the state House.

The bill heard in committee Wednesday is a substitute for an earlier version that was tabled amid concerns that it went beyond decriminalizing marijuana possession and instead legalized it.

The revised bill makes possession of up to an ounce of marijuana by a person 21 or older a civil offense punishable by a $250 fine, rather than a criminal offense. Possession by those under 21 would still be considered a misdemeanor but would not be punishable by prison time.

Under current Delaware law, possession of even small amounts of marijuana is punishable by up to six months in prison and a $1,150 fine.
