UPDATE: Bundick Back In Court For Pre-Trial Hearing

ACCOMAC, Va. - Tonya Bundick, convicted Accomack County arsonist, made her final appearance in court before her next trial.

The Parksley woman made her way into the room, with ankles shackled, on Monday. A motions hearing called to discuss an investigative technique used last year. Two FBI agents testified about using K-9's to try and match a human scent from a March 2013 arson in Keller. The agents say they were trying to determine the route a suspect may have used.

"It's not definitive evidence," said FBI special agent Rex Stockham. "It's not a fingerprint, it's not DNA. It's not definitive. I would never testify that it is. It's a search tool."

The searches came up empty-handed, so prosecutors say it isn't even part of their case. Judge Glen Tyler ultimately ruled that prosecutors should show the defense any reports from the Keller arson search if reports exist. Defense attorney Allan Zaleski also looked to keep some evidence locked away during her upcoming trial. He argued that if there's only one charge, why allow the Commonwealth to bring up the remaining 61 charges?

"The judge said that he's keeping [commonwealth attorney Gary Agar] and his opening statements at the trial in July from mentioning other incidents, which is a help and we're going to take things as they come," said Zaleski.

The state may bring up evidence during the course of the trial if they can prove Bundick had knowledge of the other fires.

Court didn't end with just a surprise appearance by federal agents. The commonwealth brought up sentencing Bundick for her January conviction. Zaleski questioned the rush since Charles Smith, her alleged co-conspirator has yet to be sentenced from his October 2013 guilty plea.

"The reason [for Agar asking for sentencing is] that once he gets sentenced, then Mr. Agar won't have any control over Smith," said Zaleski. "It'll be over with and who knows what [Smith will] say at those trials."

Smith is expected to testify next month against his former fianceé. Bundick's trial is scheduled for July 14th.
