Bodenweiser Takes Stand, Admits He Showed Boy Pornographic Movies

GEORGETOWN, Del. - Eric Bodenweiser took the stand Thursday for approximately four hours, adamantly denying all of the accusations of sexual molestation against him. However, he confessed that he showed the accuser pornographic movies on three or four different occasions in 1991, when the boy was 14-years-old.

Last week, the accuser testified that the alleged acts of sexual molestation happened between the ages of nine and twelve. Bodenweiser says he never touched the boy and only showed him the movies when he was fourteen. He said it was a "horrible mistake I made." Bodenweiser testified that the accuser showed up inside his house, uninvited a number of times. The first time, Bodenweiser allegedly told the boy to go home. The second time, Bodenweiser testified that he found the boy in his bedroom, looking at one of his playboy magazines. He tried to snatch the magazine from the boy, but said the boy wouldn't give it back unless he showed him one of his pornographic movies; and so he did. After three or four times of showing the boy pornographic movies, he says he stopped because "I realized I might, could be in trouble for such a thing."

The state spent quite some time around the testimony of Duane Smith, who is Bodenweiser's pastor and spiritual advisor. In notes that the pastor wrote during a reported confession by Bodenweiser, it says that Bodenweiser showed the boy x-rated movies, touched the boy, and had oral sex with the boy. Thursday, Bodenweiser claimed that the pastor was "mistaken in what he put in his notes. I don't think he was listening to me," he said. Bodenweiser also said that the pastor had some control over him.

"That's something the jury is going to have to wrestle with. It's Mr. Bodenweiser's contention that the pastor misunderstood the conversation that occurred on October 5, 2012. So the jury is going to have to figure that out," Bodenweiser's attorney Eric Mooney said.

As for the motion to reduce the first degree sexual intercourse charges down to third degree, Mooney says the court is contemplating giving the jury the option to convict him on the first degree charges or the lesser third degree charges, if they find him to be guilty. The judge's final decision should come down Friday before the jury deliberates.

The defense rested its case, but the state could come back with a rebuttal Friday morning. Closing arguments are also expected to take place Friday, and the jury should have the case in their hands for deliberation.
