More Witnesses Testify In Day 7 Of Bodenweiser Trial

GEORGETOWN, Del. - Eric Bodenweiser walked out of court just after noon on Tuesday, after another short day in his sexual molestation trial.

"The State has the burden of putting it together in a nice package, and the more interruptions there are, the more difficult it is to put the package together," defense attorney Joe Hurley told reporters.

State prosecutors called Bodenweiser's ex-wife to the stand.  Ruth Bennett told the court she'd never seen a tanning bed or race car at their home on what's now Flood Street in Frankford, two places the accuser claims sexual activity took place. 

Testimony by Delaware State Police's lead investigator on the case showed apparent inconsistencies in the accuser's claims, including the number of sexual encounters.

"To which it goes right to the heart of showing what was said is wrong," said Hurley.

A new revelation, radio host Dan Gaffney called Bodenweiser after the accuser called his show back in October 2012, and told him a man from Florida, the accuser, said Bodenweiser did something "bad" to him, not mentioning what that "bad" thing was.

Gaffney says Bodenweiser hold him "I never touched anybody," although Hurley pointed out, there's no way for Gaffney to have known if Bodenweiser hadn't been told about the accusations before the call.

The defense says their case starts back up Monday morning, and according to Bodenweiser's attorney, that should only take about a day.  Then, he expects this case to be in the jury's hands by Friday.

After court, Hurley requested the judge reduce the severity and number of charges against Bodenweiser, asking that first degree unlawful sexual intercourse charge be dropped to third degree, reducing the number of years he could serve.  Right now, Eric Bodenweiser is looking at a maximum of life in prison.

The Department of Justice expects the court will rule on that motion Wednesday morning.
