Accuser Breaks Into Tears On The Stand In Bodenweiser Trial

GEORGETOWN, Del. - Tears on the stand in day six of the Eric Bodenweiser sex abuse trial, as the alleged victim broke in to tears during cross examination.

The former State Senate candidate didn't respond to reporter questions Friday, after the defense continued to question the alleged victim with a  focus on discrediting Bodenweiser's accuser, pointing out apparent inconsistencies between his testimony and what the 37 year old man previously told police and state prosecutors.

Looking toward the end of this two week trial, Defense attorney Joe Hurley says he plans to file a motion to reduce the unlawful sexual intercourse charge from 1st to 3rd degree, based on the alleged victim's relationship with Bodenweiser.

"At that stage, you give the state the benefit of the doubt, for all reasonable inferences, the statute requires that the 'victim' not be a voluntary social companion," says Hurley, "he was a voluntary social companion. On each occasion he went there, he went on his own accord."

Hurley says reducing the charge would take potential jail time for Bodenweiser from 25 - life to 2 - 25 years, though the unlawful contact charges would still be the same.

In the State's re-direct, they said some of the apparent inconsistencies were the result of typos on the part of the Department of Justice.

Court resumes Tuesday morning at 9:00 AM.
