Alleged Molestation Victim Takes The Stand In Bodenweiser Sex Abuse Trial

GEORGETOWN, Del. - Dramatic new details in the sexual molestation case of Eric Bodenweiser.

He was back in court this morning, but today he faced his accuser, who took the stand for the first time, sharing with the jury some shocking testimony.

The now 37 year-old the Frankford man went into graphic detail, describing what allegedly happened to him more than 20 years ago.

After the first of two reported instances of intercourse, the accuser said Bodenweiser laughed, and told him quote "I just got tested for AIDs today, and they told me I'm positive."

Bodenweiser's attorney, Joe Hurley, says that's far from the truth, telling 47 ABC, "the man speaks with a forked tongue."

During testimony, the plaintiff outlined five instances of oral sex and/or anal sex, over about a 2 year period.

The accuser told the court he didn't say anything until 2012 because he was embarrassed and afraid of Bodenweiser, who at the time of the alleged crimes, was in his late twenties.

Prosecutors asked why he kept going back; the 37 year-old said "I wanted encouragement...I didn't get that from my father."

Cross examination starts Tuesday morning.  According to Bodenweiser's attorney: he was caught off guard by the testimony, which he claims was a much different story from what was originally reported to police.

"The sequence of acts, what happened, when it's just like 'what are you talking about'," said Hurley.

Monday, the accuser said he told his parents what happened back when he was 17, but they asked him to keep it quiet.  It was when he heard Bodenweiser was running for office that the man says he felt compelled to speak up, calling in to Dan Gaffney's talk radio show on Delaware 105.9.  Gaffney, along with a childhood friend of the accusers, and a Delaware Sate Police Trooper who took the accuser's initial call to police also took the stand.  

The judge issued a gag-order, which is why state prosecutors won't comment on the trial.

Court starts back up again Monday at 9 AM, and the defense team tells 47 ABC, they plan to start by playing the recording of the alleged victim's original statement to police.

Eric Bodenweiser faces 14 counts of 1st degree unlawful sexual intercourse, and 14 counts of 2nd degree unlawful sexual contact.
