Bodenweiser's "Confession" Main Focus Of Opening Arguments

Posted: Updated:

GEORGETOWN, Del. - Opening arguments wrapped up Friday morning in the trial of Eric Bodenweiser.

State Prosecutors went into graphic detail on the dozens of times Eric Bodenweiser, the former Delaware State Senate Candidate, allegedly forced a young boy into mutual masturbation, oral, and anal sex more than 20 years ago.

The acts reportedly started when the victim was just 10 years old, and lasted for three years, but even in the face of an apparent confession by Bodenweiser himself, the defense maintained his innocence.

"Not guilty of any of the things charged," said Joe Hurley, Bodenweiser's attorney.

In opening arguments Friday, both sides agreed Bodenweiser told his pastor, Duane Smith, who was the sole witness called to the stand Friday, "I did it."

Hurley told reporters "we will agree that there is a quote confession unquote."

This confession, after news of the alleged abuse broke in 2012.  On multiple occasions, Bodenweiser apparently let the, now adult, accuser watch pornographic movies at his home, though that's where the similarities in the stories end.

The pastor's statement goes on to say "while they watched the movie, there was some oral sex."

"Is the "it" sexual activity between the two? Denied! Or is the "it" allowing the 14 year old kid to watch prohibited movies in the defendants house?" said Hurley.

The State alleges Bodenweiser told his pastor he showed the videos before forcing him into sexual activity.  The Defense claims it was just poor judgement, and that nothing physical happened.

Prosecutors are under a gag order, and wouldn't speak to media, but Bodenweiser's attorney Joe Hurley told reporters his strategy for the trial, "you can expect the total elimination of the credibility."

Witness testimony will resume Monday morning.  At some point during the two week trial, the victim is expected to take the stand.
