The charges stem from a February 19th, 2013 incident where Brumbley hit a tow truck then a guard rail on Northbound Route 13, with two male passengers in his car. A Delmar Police Officer talked to Brumbley, who was showing signs of being under the influence of alcohol. There were also several empty beer cans in the car.

All three of the men were taken to Peninsula Regional Medical Center after the crash, eventually one of the passengers 54-year-old Thomas Hitch was air lifted to University Hospital Shock Trauma in Baltimore, because of the seriousness of his injuries.
