New Workers Comp Report Released To DE Lawmakers

DELAWARE - A state task force created to examine Delaware's sky-rocketing workers' compensation rates reportedly released recommendations to the governor and the General Assembly this week.

According to reports, the 20-member Delaware Workers' Compensation Task Force, made up of business and legislative leaders, was created in 2013 to address a 34 percent increase in rates over the prior two years. Officials say the task force delivered its first set of recommendations in May 2013 that formed the basis of House Bill 175 which passed the House and Senate unanimously, but the new law couldn't stop rates from rising once again in December, this time between 11.4 and 14 percent.
 
Calling the increases unacceptable, the task force reportedly decided to continue meeting and come up with stricter measures to control premiums. The new recommendations reportedly include the creation of a new medical fee schedule, using multipliers of medical codes used by the Centers for Medicare and Medicaid Services, which results in a 33 percent savings from all providers to be phased in over three years. Officials say twenty percent of the reduction would occur immediately.
 
The task force also reportedly recommends heightened oversight of insurance carriers and the consideration of a change in the rating organization used by Delaware insurance carriers.
