Millsboro Residents Continue Their Fight Against Chicken Plant

MILLSBORO, Del - The battle continues over an Allen Harim chicken processing plant coming to Millsboro.

According to reports, the community group Protecting Our Indian River filed a brief to reverse Sussex County's zoning decision, which allows the plant to take over the old Vlassic Pickle site.

In the filing, the group's counsel, Richard Abbott, reportedly requests that the Delaware Superior Court invalidate the Sussex County Board of Adjustment's approval based on procedural and legal errors associated with Allen Harim's application. Abbott reportedly argues that the board lacked jurisdiction to approve the zoning request and provided insufficient oversight by green-lighting a list of consultant agencies that was provided by Harim. Abbott claims the board was required by law to "solicit and obtain" input from relevant agencies such as the Delaware Division of Public Health in the interest of public health and water quality protection, but they did not get such consulting.
