Family Of Victim In Police-Involved Shooting Takes Legal Action

SALISBURY, Md. - The family of a man killed in a police-involved shooting is taking preliminary legal action against Maryland State Police.

Nearly a month ago Winfield Fisher was killed just outside the Maryland State Police barracks in Salisbury. The attorney for Fisher's family tells 47 ABC that they filed a notice under the Maryland Tort Claims Act, essentially letting the government known that there may be a potential claim.

Fisher was shot on March 18th when he reportedly went to the police barrack for a repair order on his car. Investigators say Fisher asked an officer to check and sign an inspection ticket. Then shots were reportedly fired and a trooper was dragged by Fisher's car.

But what led to that altercation is still unknown.

"They lost their son, the father of their grandchild," said Larry Greenberg, an attorney for the Fisher family. "I'm hoping we will take additional action to move this case forward. Essentially, Winfield got a traffic violation for a tag light, a rear stop lamp. He got it fixed and he drove his vehicle up to the police state trooper barracks and that is the last hard fact that we know."

Greenberg and the Fisher family requested information under the Freedom of Information Act, or FOIA. They say that information hasn't yet been provided.

47 ABC asked Maryland State Police about the case, they say the report isn't finalized and they will not make any comments at this time due to the ongoing litigation.
