UPDATE: State Drops Charges Against David Nettles

WICOMICO CO., Md. - The State of Maryland has decided to drop its charges against a former Wi-Hi football coach, accused of sexually abusing a former student. The State says they have dismissed the case against David Nettles, even though the victim is still maintaining his allegations again the Defendant.

The victim, who was 17-years-old at the time of the incident, has apparently testified in two criminal proceeding against Nettles, and has told the State's Attorney's Office that he doesn't want to testify in a third trial. In those two previous trials, both ended in a hung jury, meaning that they couldn't reach a unanimous verdict.

"It's a lot for a victim to go through a trial such as that," Wicomico Co. deputy state's attorney Ella Disharoon said. "He's just elected that at this point in time. He doesn't want to go through it a third time."

The State says it respects the victims' position, and entered a nolle prosequi, or a dismissal of all charges, when the case was called on Monday morning. This means that at this time David Nettles is presumed innocent. At a later time the State can decide to go ahead and prove his guilt beyond a reasonable doubt.
