Location Fate Of Punkin Chunkin Still Unknown

SUSSEX CO., Del. - Still no location for this year's Punkin Chunkin, but apparently there is a launch date.

It was just announced that pumpkins will fly a week earlier from October 24th-26th. But the proposed legislation trying to keep the event in Sussex County is now off the table.

Sen. Brian Pettyjohn (R-Dist. 19), who sponsored the bill, recently shelved the idea after conversations with Punkin Chunkin organizers and the Delaware Trial Lawyers Association.

The proposal would have created a liability cap. The event is facing a lawsuit from a former volunteer who reportedly suffered spinal fractures at the event back in 2011.

"They feel that the legislation is not necessary, because they can within the contracts between the association and the landowner, offer the same type of protection to the landowner instead of going through the legislative process to fix a problem," said Pettyjohn. "As of right now it does look like Punkin Chunkin will be able to remain in Delaware, as long as the parties can come to an agreement on the contract."

Punkin Chunkin representatives tell WMDT the organization is working with the landowner to try and keep the event in Sussex County. They plan to make a decision by the end of March.
