UPDATE: Bundick Pleads Out After Evidence

VIRGINIA BEACH, Va. - Tonya Bundick has pleaded out. WMDT's Kody Leibowitz reports that Bundick used an Alford plea, meaning that she is not admitting guilt, but that there is enough evidence to convict her.

She pleaded guilty to conspiracy to commit arson and arson for the night of April 1st, 2013. Bundick testified after evidence was handed out. No word yet on why she changed her plea, but her lawyers tell WMDT Bundick made the call.

As of 12:30 PM, the defense had rested. During Tuesday's proceedings, they replayed a phone call from the night of the fire between Bundick and Charles Smith, to the court.

Earlier Tuesday, Smith was cross examined by Bundick's lawyers. They were apparently trying to prove that Smith is trying to keep her in jail, while trying to reduce his own sentence. Smith reportedly originally didn't want to testify against Bundick. Smith has not been sentenced yet, but is facing up to 584 years behind bars after pleading guilty to 68 counts of arson, in October. Smith allegedly sent Bundick a letter, asking her to wear a ring, to let others know she's "taken."

A Virginia State Police Special Agent also took the stand, and went over what was found in the gold van that the two were in when they were arrested. The special agent said there was paraphernalia, clothing, rags, lighters, but no accelerant.
