Judge Mulls Injunction To Halt DE School Closing

Posted: Updated:

WILMINGTON, Del. (AP) - A federal judge is weighing whether a failing, all-girls charter school in Delaware should remain open for another year.

State officials announced in November that Reach Academy for Girls, a predominantly black school in New Castle with a history of financial and academic struggles, will close at the end of the school year.

Reach officials claim the school has been treated unfairly and is the subject of gender discrimination. On Thursday, their attorneys asked the judge to grant a preliminary injunction extending the school's charter for one year.

A Department of Education attorney argued that such a move would be unprecedented, and that Reach officials have failed to show any violation of due process or equal protection rights.

The judge is expected to issue his decision within a week.
