Charges Dropped In Magnolia Murder Case

MAGNOLIA, Del. - State prosecutors have dropped a murder case in Delaware, after key evidence wasn't allowed in the trial.

October 2012, Jermaine Zachary was charged with second degree murder, as an accomplice in the 2009 armed robbery, and shooting death of Robert Walkins near Magnolia, Delaware.

Zachary was set to stand trial December 16th, but according to the Department of Justice, earlier this fall, the Delaware Superior Court approved a defense motion to suppress cell phone records, which the state says were instrumental to their case.  The charges can be re-filed if additional evidence is found linking him to the crime.

Jermaine Zachary is currently being held on gun and reckless endangerment charges related to a separate incident,  a shooting which happened June 2013.

The gunman in the 2009 murder is reportedly still at large.
