Posted: Updated:

WORCESTER CO., Md. - Accused murderer Matthew Burton will be staying in Maryland, for now.

He will be held in a Worcester County jail indefinitely after his habeas corpus petition was denied Monday.

Burton's attorney's appealed the decision with the Maryland Court of Special Appeals, and according to the Worcester County State's Attorney's office, he is simply waiting until the court of appeals takes up the case.  The the Maryland Attorney General's Office will handle the case from here on out.

In October, WMDT first learned Burton was battling his extradition from Maryland to Delaware after investigators allege he raped and killed Millsboro mother Nicole Bennett in Delaware.
