DOVER, Del. (AP) - A former Bank of America executive charged with trying to have sex with a 13-year-old girl says he has no money in the bank and can't afford an attorney.
A federal grand jury returned an indictment this week charging 59-year-old Kirk A. Simmons of Newark with attempted enticement and coercion of a minor and attempted production of child pornography.
Simmons said in an affidavit filed Wednesday that he has no money in savings or checking accounts and doesn't own stocks, bonds or real estate. He is asking for a public defender.
Simmons was arrested in July outside a Newark hotel where he allegedly had arranged with an undercover detective to have sex with the fictitious girl. He was subsequently fired from his job as a Bank of America vice president.
