Smith Wants Evidence Thrown Out In Accomack Arson Case

ACCOMACK CO., Va - WMDT has learned that the attorney for Charles Smith is trying to get some evidence thrown out in the case. They have filed a suppression motion, asking the judge for certain evidence not to be allowed.

It's unclear just what evidence is under question. Smith was arrested and charged in connection to the April 1st fire set to a vacant building in Melfa. Just last month, he was indicted on an additional 67 counts of arson and one count of conspiracy to commit arson. At this time, a date has not been set for motions hearing.

Smith's fiance, Tonya Bundick, is also charged in the case. In August, a judge ruled that Bundick could be released, if she posted $30,000 secured bond. As a condition, the 38-year-old would not be able to leave Accomack and Northhampton Counties, unless deemed medically necessary. Bundick has only been indicted on two counts related to the April 1st arson. To be released, Bundick would only have to put down $3,000, which is ten percent of her bond.
