MD Judge Won't Dismiss College Beating Lawsuit

BALTIMORE (AP) - A judge says she won't dismiss a lawsuit against Maryland's Morgan State University, which accuses the school of negligence for ignoring escalating warning signs that one of its students was a threat to others.
    
The student, Alexander Kinyua, ultimately attacked a visitor to the campus with a baseball bat. About a week later, he acknowledged to authorities that he killed a man staying with his family and ate the man's heart and parts of his brain.
    
A lawyer for the school asked the judge to dismiss the lawsuit Monday at a hearing in Baltimore, saying the 2012 beating wasn't reasonably foreseeable given the student's past behavior. But the judge agreed with lawyers for the injured visitor, Joshua Ceasar, and said the historically black college should have known something was "askew."
