DE Supreme Court Rules In Favor Of Ruddertowne Project

DEWEY BEACH, Del. - The Delaware Supreme Court ruled in favor of the Ruddertowne project's developers, Dewey Beach Enterprises, and the town today.

The fight started nearly seven years ago, when the developer reportedly proposed to build a 68-foot-tall complex despite a 35-foot building restriction in the town. When the proposal was denied, the developer allegedly sued the town.

A private settlement was negotiated, giving permission to build up to 45 feet.  As a result, four residents sued the town and Dewey Beach Enterprises.

According to today's ruling, the residents lost the fight against the project because they did not file their action in time.
