Ocean City Seeks Dismissal of ACLU Lawsuit

OCEAN CITY, Md. - The town of Ocean City is now fighting a federal lawsuit against it's boardwalk noise ordinance filed in April. 
 
Ocean City hopes the federal civil suit will be dismissed, apparently the American Civil Liberties Union is suing the town on behalf of a street performer who alleges the town's 30 foot noise ordinance on the Boardwalk is unconstitutional.

According to town officials, the police officer never asked the man to stop playing his music -- just to turn down the volume of his music to conform to the 30-foot rule.
