DELMAR, Md. - The man accused of killing 70,000 chickens is set to go to trial.
"I don't think there are any weaknesses in the case or anything. Insurance didn't cover the loss, so Allen is out - they're out $175,000 unfortunately. It's a shame for everybody," attorney for Allen Family Foods Christina Alfonsi said.
The states attorney filed criminal information, meaning instead of a preliminary hearing, it's going directly to circuit court.
Back in August, 21-year-old Joshua Shelton of Delmar allegedly cut off the power in three poultry houses and was found lying in the power control shed at a poultry farm on east line road. Police say he smelled of alcohol. When we spoke to Shelton last month, he was adamant that all the charges against him should be dropped.
"A big misunderstanding really what it is. The trespassing charge is definitely not good because I was invited there - not trespassing. I didn't burglarize anything - I didn't steal anything. And malicious destruction of property, I didn't destroy anything. I don't' mind paying restitution on some of the chickens - not all of them because I believe that it wasn't all my fault," he said.
Shelton plans to request a trial by jury. A trial date has yet to be set.
